Keskinäisen testamentin nojalla, jolla oli määrätty, että eloonjäänyt puoliso sai elää jakamattomassa pesässä ja hallita pesän kiinteätä ja irtainta omaisuutta, hänellä katsottiin olevan oikeus myydä pesän kiinteistöstä maa-alue.
